Recent rapid changes in U.S. trade policy have raised numerous questions for the electronics sector. After the U.S. Supreme Court’s landmark ruling on February 20, 2026, invalidating tariffs enforced under the International Emergency Economic Powers Act (IEEPA), billions of dollars in collected duties now must be legally refunded.
We want to reassure our customers and partners that the entire electronics manufacturing industry is currently facing the same situation. We are all awaiting the federal government to establish the necessary infrastructure to release these funds.
Here is the current, accurate update on where tariff refunds stand now and what to expect going forward.
The Federal Roadblock: Building a New System
On March 4, the U.S. Court of International Trade (CIT) directed U.S. Customs and Border Protection (CBP) to cease collecting IEEPA tariffs and to start issuing refunds. However, given that processing the roughly 53 million affected entry shipments would take millions of hours of manual work with CBP’s current systems, the Court temporarily paused the requirement for immediate refunds.
Instead, the government has proposed a streamlined solution:
- The 45-Day Window: CBP is currently building an entirely new, automated refund system within its Automated Commercial Environment (ACE) platform.
- Timeline: CBP estimates this system will be operational in mid-to-late April 2026.
- Consolidated Payouts: Rather than issuing refunds on a per-shipment basis, the Treasury Department intends to issue a single, consolidated electronic refund (with interest) to each eligible Importer of Record.
The Electronic Requirement
Please note that starting February 2026, CBP will no longer issue paper refund checks. All refunds must be handled electronically through the Automated Clearing House (ACH). Importers without correctly enrolled banking information in the ACE portal will face rejection and delays in their refunds.
